Terms of Service
Private Messaging & Collaboration Platform
1.Operator Information
Welcome to Aero (Package: com.aryankaushik.aero), a private messaging and collaboration application. Aero is developed, owned, and operated by Aryan Kaushik.
By accessing or using the Aero application across any of its supported platforms (Android & Web), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must immediately discontinue use of the application.
2.Eligibility & Account Creation
To create an account and use Aero, you must meet the following age requirements:
- India: You must be 18 years of age or older to use the platform, in accordance with the India Digital Personal Data Protection Act (DPDP Act, 2023).
- Global: Where permitted by local law, you must be at least 13 years of age.
Aero does not provide a parental consent flow. By registering for an account via email and OTP verification, you affirm that you meet the minimum age requirement for your jurisdiction. We reserve the right to instantly terminate accounts if we discover they belong to users under the required age limit.
3.User Conduct & IP Ownership
Aero provides features including 1:1 Direct Messages, Docks (Communities), Stories, Workspaces (Tasks, Notes, Calendar), and Real-time Meetings. End-to-End Encryption (E2EE) for 1:1 Direct Messages and Private Docks is currently in final testing and is not yet generally available. Until it is made available to you, these communications are encrypted in transit and at rest on our servers, as described in our Privacy Policy. When E2EE becomes available and you enroll, Aero will not hold the decryption keys and will not be able to access, read, or moderate the content of those specific communications. You are solely responsible for the content you create, transmit, and store on the platform.
3.1 Prohibited Conduct
You agree not to use Aero to:
- Engage in harassment, bullying, or abusive behavior toward other users.
- Transmit, store, or share illegal content, including material that infringes intellectual property rights or violates applicable laws.
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
- Distribute spam, unauthorized advertisements, or malicious software.
3.2 IP Ownership
You retain full ownership of all intellectual property rights to the content you upload, share, or create within Aero.
However, to operate the service, you grant Aero and Aryan Kaushik a worldwide, non-exclusive, royalty-free license to host, store, transmit, and display your content. This license is strictly limited to the purpose of operating the application and is particularly relevant for content that is not end-to-end encrypted, such as messages, Dock files, profile pictures, and voice notes, which are securely stored in our cloud infrastructure.
4.Subscriptions, Payments & Refunds
Aero offers a Free plan and three paid plans, Apex, Pro and Max, together with optional paid add-ons and one-time purchases. Payments are securely processed through our authorised third-party billing providers and payment processors. Which provider handles your purchase depends on where you buy: purchases made in the Android app are processed through Google Play Billing, and purchases made on the web are processed through our web payment processor.
4.1 Recurring and One-Time Purchases
It is important to understand which of our paid products renew and which do not:
- Paid plans (Apex, Pro and Max) are recurring subscriptions. Apex renews on a monthly or yearly cycle, depending on the option you choose. Pro and Max are currently offered on a monthly cycle only. The three paid plans include the same Aero features and differ only in the amount of Grace AI usage included (see Section 9).
- Grace credit packs (additional AI credits, previously sold as monthly "Grace Boost Add-ons") are a one-time purchase. They do not renew, and you are charged only when you choose to buy a pack. See Section 9.
- Aero Drive storage add-ons are recurring subscriptions that renew for as long as you keep the extra storage.
- Premium handles are a one-time purchase. They do not renew and you will not be charged again for a handle you have bought. See Section 6.
4.2 Automatic Renewal & Billing Cycle
Your subscription renews automatically
Paid plans (Apex, Pro and Max) and Aero Drive storage add-ons are automatically renewed and charged at the start of each new billing period, using your selected payment method, until you cancel. To avoid being charged for the next period, you must cancel at least 24 hours before the current period ends.
Your billing period begins on the date your purchase is confirmed and renews on the same date of each subsequent month (or year, for yearly Apex plans). The renewal price, the renewal date, and the payment method used are shown to you at the time of purchase and can be reviewed at any time in your billing provider's subscription settings.
If we change the price of a recurring product, we will notify you in advance. Where required by the app store or by applicable law, a price increase will not take effect for you until you have consented to it; if you do not consent, your subscription will not renew at the new price.
4.3 How to Cancel
You may cancel any recurring purchase at any time, and cancellation is always possible before the next billing cycle is charged:
- Purchases made through Google Play: open the Google Play Store app, go to "Payments and subscriptions", select "Subscriptions", choose the Aero product, and select "Cancel subscription". You may also manage these from your Google account on the web.
- Purchases made on the web: cancel from the subscription management screen in Aero, or through the billing portal link included in your purchase confirmation email from our payment processor.
- If you need help cancelling, contact us at the address in Section 14 and we will assist you.
Please note: uninstalling the Aero app does not cancel a subscription, and deleting the app alone will not stop future charges. You must cancel through the relevant billing provider as described above.
Effect of cancellation. Cancellation stops future renewals; it does not end your current paid period. You keep access to the paid benefits until the end of the period you have already paid for. Grace credit packs are not subscriptions, so there is nothing to cancel: credits you have bought stay available until they expire as described in Section 9. If you held a monthly Grace Boost Add-on before credit packs were introduced, it will not renew again; the credits for your current period remain usable until that period ends, after which any remaining add-on credits are removed from your ledger. Grace credits are a usage allowance, are not stored value or money, and are not exchangeable for cash.
4.4 Cancellation on Account Deletion
If you permanently delete your Aero account, the system will automatically attempt to cancel your active subscription with the corresponding billing service before wiping your database records, in order to prevent orphaned charges. We nevertheless recommend that you confirm the cancellation directly with your billing provider, since subscriptions purchased through an app store are ultimately controlled by that store.
4.5 Refunds
Aero does not offer automated refunds. All purchases, including paid plans (Apex, Pro and Max), Grace credit packs, storage add-ons, and premium handles, are governed by the terms and policies of the respective payment processor or mobile app store platform and are generally non-refundable.
Nothing in this section limits any non-waivable statutory right you may have as a consumer, including any right to cancel or to a refund under the Consumer Protection Act, 2019 or other applicable consumer protection law in your jurisdiction.
4.6 Changing Plans
- Upgrading on the web: you can move to a higher paid plan (from Apex to Pro or Max, or from Pro to Max) at any time. The upgrade takes effect immediately and you pay only the difference for the days left in your current billing period; from your next renewal you pay the price of the new plan. The upgrade only takes effect if that payment succeeds.
- Upgrading from a yearly plan: because Pro and Max are offered monthly only, upgrading from a yearly Apex plan moves you to monthly billing. The unused part of your yearly plan is credited toward what you pay next. We show you the change in billing before you confirm.
- Moving to a lower plan: cancel your current plan as described in Section 4.3. You keep your current plan until the end of the period you have already paid for, and you can then subscribe to the lower plan.
- Purchases made through Google Play: upgrades, downgrades and any proration between Apex, Pro and Max are handled by Google Play under its own rules, and Google Play shows you the details before you confirm.
5.Aero Drive (Cloud Storage & File Sharing)
Aero Drive is Aero's cloud file storage and file-sharing feature. Files you upload to Aero Drive are stored as fixed files; Aero Drive is a storage and sharing product, not a collaborative document editor.
5.1 Storage Quotas & File Limits
- Included storage: Free accounts receive 5 GB. Accounts on any paid plan (Apex, Pro or Max) receive 20 GB.
- Storage add-ons: Additional capacity may be purchased as a recurring subscription, starting at 50 GB. Add-on capacity is added to your included storage. The tiers available for purchase may change over time.
- Maximum single file size: 2 GB, increased to 10 GB if you are on a paid plan (Apex, Pro or Max) or hold any paid storage add-on. These limits are separate from the chat and media limits in Section 7.
5.2 Sharing Files
You can share a Drive file either by granting access to specific Aero users, or by creating a shareable link. In both cases the recipient must sign in to an Aero account before the file will open or download, so Drive files are never served anonymously. A file can have one active shareable link at a time, and you can revoke a link or an individual grant at any time.
Download links issued for a share are short-lived and expire automatically. Once you revoke a share, no new download links can be issued for it; a download link that was already issued may continue to work until it expires.
You are responsible for what you share and with whom. Anyone you give access to can open and download the file, and can therefore keep their own copy. Aero does not, and cannot, prevent a recipient from saving, copying, or re-sharing a file you have given them access to. Treat a shareable link as sensitive: anyone who obtains it and has an Aero account may be able to access the file until you revoke it.
5.3 Automated Safety Scanning
Files uploaded to Aero Drive are automatically scanned before they can be shared or downloaded. Files that fail scanning, including files whose actual content does not match their declared file type, are quarantined and cannot be shared or downloaded. We may remove or restrict access to any file that is unlawful, that infringes another person's rights, or that otherwise violates Section 3.
Aero Drive is not end-to-end encrypted
End-to-End Encryption, once it becomes available for 1:1 Direct Messages and Private Docks, will not apply to Aero Drive. Drive files are encrypted in transit and at rest, but Aero is technically able to process them in order to run safety scanning and generate previews. Do not use Aero Drive for material you require to be inaccessible to the service operator.
5.4 Exceeding Your Storage Quota
If your storage entitlement is reduced, for example because you cancel a storage add-on or your paid plan ends, and you are then using more space than your remaining quota allows, the following process applies:
- Your Drive enters a read-only recovery period of 30 days. Your files stay intact and you can still download them, but you cannot upload new files.
- If you are still over quota after that period, we prepare a deletion plan, show it to you before anything is deleted, and wait at least a further 72 hours.
- Only enough files to bring you back within quota are deleted. We do not delete your entire Drive for being over quota. Files are selected starting with Trash, then unstarred files oldest first, and starred files last. You may override this and choose what to keep.
- If you return within quota at any point before deletion runs, by renewing, upgrading, or deleting files yourself, the deletion plan is cancelled.
Aero Drive is not a backup service. You are responsible for keeping your own copies of anything important. To the extent permitted by law, we are not liable for the loss of files stored in Aero Drive, and our liability in any event remains subject to Section 11.
7.File Size Limits & UGC Caps
To ensure fair usage of cloud resources, Aero enforces strict file size limits on user-generated content (UGC) based on your subscription plan:
Free Plan Limits:
- Images/Photos: 500 MB
- Audio/Voice Notes: 100 MB
- Videos: 500 MB
- Documents/Files: 500 MB
Apex, Pro, and Max Plan Limits:
- Images/Photos, Videos and Documents/Files: 4 GB per file
- Audio/Voice Notes: 500 MB per file
- Encrypted Cloud Storage: 20 GB included (expandable with storage add-ons)
- Grace AI Allocation: 750 cr (Apex), 4,000 cr (Pro), 10,000 cr (Max)
8.Docks Specific Rules
Docks act as communities or shared workspaces within Aero. The following rules apply:
- Ownership & Deletion: If the creator or owner of a Dock permanently deletes their Aero account, the entire Dock is instantly wiped. This includes all Dock messages, members, notes, tasks, calendar events, and cloud storage media. Please note that this deletion occurs without any prior warning or notification to Dock members. Ownership does not automatically transfer to another admin.
- Admin Powers: Dock administrators have the authority to ban users, moderate content, and update the Dock's privacy settings (e.g., toggling between Public and Private/Require Approval modes).
- Dock Handles: A public Dock may hold a handle (@username) drawn from the same global namespace as user handles, so a Dock handle and a user handle can never be identical. Handles may be free or purchased, and purchased handles belong to the buying account rather than to the Dock. If a Dock is deleted, a handle you paid for is not lost. See Section 6.
9.G.R.A.C.E. AI Specific Terms
Aero includes an integrated Retrieval-Augmented Generation (RAG) AI system known as G.R.A.C.E. (utilizing advanced third-party language models).
Credit System: AI usage is gated by a credit ledger. Each plan includes a usage allowance that is shared by Grace chat and Grace Forge and is tracked over weekly and monthly periods. Each reply uses part of your allowance based on how much work it takes, so a short answer uses less than a long or deeper one. The Free plan includes a small allowance; Apex includes a larger one; Pro and Max include several times the Grace usage of Apex (see Section 7). Some Grace features, such as Grace 3 Ultra, are available on paid plans only.
Grace credit packs are one-time purchases that you can buy whenever you need more Grace usage. A pack is charged once and never renews. Credits from a pack remain valid for 365 days from the date of purchase, are used only after your plan's weekly and monthly allowance, and are spent in order of earliest expiry. If you are on the Apex plan when you buy a pack, you also receive 20% bonus credits, which expire at the same time. Credits that are not used before they expire are lost and are not refunded. Credits are a usage allowance only: they are not money, hold no cash value, and are not transferable, exchangeable or refundable for cash.
Critical Liability Disclaimer: Outputs generated by G.R.A.C.E. AI are provided for convenience and informational purposes only. The AI may produce inaccurate, incomplete, or hallucinated information. G.R.A.C.E. outputs do NOT constitute professional, legal, financial, or medical advice. You should never rely on AI-generated content as a substitute for independent judgement or professional consultation. Aero and its developer assume no liability for decisions made or actions taken based on AI outputs.
10.Account Suspension & Termination
You may terminate your relationship with Aero at any time by deleting your account.
Deletion happens in two stages. Deleting your account requires confirmation with your password and a one-time passcode. On confirmation, your account is immediately deactivated, every active session is revoked, and your profile stops being reachable by other users. Permanent deletion is then scheduled for 30 days later.
You can cancel during the 30-day window. If you sign in again at any point before the 30 days elapse, your account is restored with the same account identity and your data intact. A short cooldown applies before you can request deletion again.
After 30 days, deletion is permanent and irreversible. Your user record, messages, calls, cloud media, Aero Drive files, and AI embeddings are deleted, any Docks you own are removed, and any public handle you hold, including a purchased premium handle, is released back into the namespace. We cannot recover an account or any of its content once this stage has run. Please see Section 6.4 in relation to handles and Section 5 in relation to Aero Drive.
We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms of Service, engaged in illegal activities, or caused harm to the platform or other users.
10.1 Survival
Upon termination or deletion of your account, all provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, IP ownership licenses, disclaimers, limitations of liability, and governing law provisions.
11.Disclaimers & Limitation of Liability
11.1 "As Is" Basis
Aero is provided on an "as is" and "as available" basis. I make no representations or warranties of any kind, express or implied, regarding the application's uptime, reliability, or accuracy. To the fullest extent permitted by law, I disclaim all implied warranties of merchantability and fitness for a particular purpose.
11.2 Liability Cap
To the maximum extent permitted by applicable law, my total aggregate liability to you for all claims arising out of or relating to the use of or inability to use the Aero application shall not exceed ₹5,000 (Indian Rupees Five Thousand) or the total amount you paid for the services in the twelve (12) months preceding the claim, whichever is lower. I shall not be liable for any indirect, incidental, special, or consequential damages.
12.Governing Law & Dispute Resolution
Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of India, specifically the Information Technology Act, the DPDP Act 2023, and the Indian Contract Act.
Jurisdiction: You agree to submit to the exclusive jurisdiction of the competent courts in New Delhi, India.
Informal Resolution: Before initiating any formal legal proceedings, you agree to attempt to resolve the dispute informally by contacting me. A 30-day informal resolution period is required before any formal action can be taken.
13.Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use Aero after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please delete your account and stop using the application.
